Van speed restriction

My van was registered in 1997, and did not come equiped with a speed limiter. Am I still banned from overtaking in the third lane on motorway?

Is your "van" over 3.5 tonnes gross if not it doesn't need a speed limiter now or after 01/01/08. If its under 3.5 tonnes its a "lorry" not a "van".
